This Privacy Policy provides information on how The Delta Campus GmbH ("The Delta", "we") processes personal data in connection with the use of the FO | NEXT website (www.fonext-summit.com) and registration platform (the "Platform") as well as on the FO | NEXT social media pages (Instagram, LinkedIn, Luma and comparable channels), for what purposes this is done, and how you can object to certain processing activities. FO | NEXT is an initiative of The Delta. We take the protection of your personal data very seriously. We treat your data confidentially and in accordance with the statutory data protection regulations and this Privacy Policy.

2. Collection and Processing of Personal Data

Personal data means any information relating to an identified or identifiable natural person. This includes, in particular, details that allow conclusions to be drawn about your identity, e.g., your name, telephone number, address, or email address. Certain identifiers such as your IP address or the device ID of your end device are also personal data.

2.1 Provision of the Website and Creation of Log Files

Each time the Berlin auf die Eins website is accessed, our system automatically collects data and information from the computer system of the accessing device. The following data are temporarily stored:

  • Information about the browser type and version used
  • Operating system and internet service provider
  • IP address
  • Date and time of access

Personal data may be transferred to the USA as part of the service; the transfer is based on Standard Contractual Clauses (SCCs) approved by the European Commission. The server log files are deleted after 14 days at the latest.

The legal basis is Art. 6(1)(b) GDPR where the page visit occurs in connection with initiating or performing a contract (including registration and use of the Platform), and otherwise Art. 6(1)(f) GDPR based on our legitimate interest in enabling website access and ensuring the permanent functionality and security of our systems. The automatic transmission of connection data and the resulting log files do not constitute access to information stored on the end device within the meaning of the EU Member States' ePrivacy implementation laws (in Germany, Sec. 25 TDDDG). In any case, such access would be strictly necessary. Legal basis: Art. 6(1)(f) GDPR (legitimate interest in secure website operation). Data in log files are stored for up to 7 days and then deleted, unless further statutory retention obligations apply.

2.2 Contacting Us

If you contact us by email or via the Berlin auf die Eins website, we process the personal data you provide (e.g., name, email address, company name, content of your message). Processing takes place solely to handle your inquiry and communicate with you.

For scheduling appointments and managing communication, we use the software "HubSpot" provided by HubSpot, Inc., 25 First Street, Cambridge, MA 02141, USA. As HubSpot is based in the USA, a data transfer to a third country cannot be excluded. HubSpot is certified under the EU–US Data Privacy Framework (DPF), ensuring an adequate level of data protection pursuant to Art. 45 GDPR. If you book a consultation appointment, you will automatically receive an invitation to a virtual meeting. We use Google Workspace services provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google's privacy information is available here: https://support.google.com/meet/answer/10382037.

The legal basis for this processing is Art. 6(1)(b) GDPR, insofar as the inquiry relates to initiating or fulfilling a contract, as well as Art. 6(1)(f) GDPR based on our legitimate interest in responding to inquiries from users and other individuals.

2.3 Registration, Account and Dashboard

Berlin auf die Eins is a registration platform. To use the Platform, you create a user account and log in to a personal dashboard, where you can manage your profile and submit ideas. When you register and use your account, we process the following categories of personal data, depending on the information you provide:

  • Identification and contact data (e.g. first name, last name, email address, account password in hashed form)
  • Profile data you choose to add (e.g. role, company/organisation, short bio, links such as LinkedIn or personal website, profile picture)
  • Authentication and usage data (e.g. account creation date, log-in timestamps, IP address of log-in, session identifiers, device and browser information)
  • Communication preferences (e.g. notification settings)

We process this data for the following purposes:

  • Creating and managing your Berlin auf die Eins account and dashboard
  • Authenticating you and keeping your account secure (e.g. detecting suspicious log-ins, preventing abuse)
  • Providing the functionality of the Platform (idea submission, notifications, updates)
  • Communicating with you about your account, service changes, and security
  • Complying with our legal obligations

The account and dashboard are provided on the basis of a contractual relationship between you and us that comes into effect when you accept the Berlin auf die Eins Terms of Use during registration. The legal basis for processing the data described above is therefore Art. 6(1)(b) GDPR (performance of a contract and pre-contractual measures). We also rely on Art. 6(1)(f) GDPR (legitimate interests) for processing aimed at the security, integrity and improvement of the Platform.

Authentication and the underlying user database are operated via Supabase, provided by Supabase, Inc., 970 Toa Payoh North #07-04, Singapore 318992 (and its affiliates). Supabase acts as a processor within the meaning of Art. 28 GDPR. Personal data may be hosted in the European Union; where data transfers to third countries occur, they are safeguarded by Standard Contractual Clauses (SCCs) approved by the European Commission and, where appropriate, additional technical measures (e.g. encryption at rest).

The Berlin auf die Eins website and dashboard frontend are hosted on Vercel (see Section 2.1). Vercel also acts as a processor within the meaning of Art. 28 GDPR.

You can update or delete your account information at any time from within the dashboard or by contacting us. If you delete your account, we will delete or irreversibly anonymise your personal data, unless we are legally required to retain certain data (e.g. for tax or accounting purposes) or need to retain it to establish, exercise or defend legal claims.

2.4 Idea Submission and Public Display on the Berlin auf die Eins Website

As a registered Berlin auf die Eins user, you can submit ideas through your dashboard. Ideas are intended to be shared publicly on the Berlin auf die Eins website to foster community engagement and visibility.

We process the following categories of personal data in this context:

  • Your name as registered on the Platform (displayed publicly alongside your account and any ideas you submit)
  • Optional profile information you choose to make visible (e.g. role, company/organisation, short bio, profile picture, links)
  • The content of the ideas you submit (title, description, supporting materials, tags, timestamps)
  • Interaction data related to your submissions (e.g. edits, status, responses from other users where applicable)

Public visibility. By registering for Berlin auf die Eins, your name is displayed on the public Berlin auf die Eins website as part of the community of registered members. When you submit an idea, the idea and your name (and any profile information you have chosen to make public) are displayed publicly on the Berlin auf die Eins website and can be viewed and indexed by search engines and third parties worldwide.

This public display goes beyond what is strictly necessary to operate your account. We therefore rely on your explicit consent pursuant to Art. 6(1)(a) GDPR for the public display of your name, profile information and submitted ideas. You provide this consent during the registration process and/or when submitting an idea. You can withdraw your consent at any time with effect for the future — either via the visibility settings in your dashboard, by removing specific ideas, by deleting your account, or by contacting us at data-protection@thedelta.io. Upon withdrawal, we will cease the relevant public display promptly. The lawfulness of processing based on consent before its withdrawal remains unaffected. Please note that content that has already been publicly available may have been cached, copied or shared by third parties over whom we have no control.

We additionally rely on Art. 6(1)(f) GDPR (legitimate interest) for aggregated and statistical analysis of submissions (e.g. number of ideas, topic clusters) in order to improve the Platform, provided that such analysis does not identify individual users.

You are responsible for the content of the ideas you submit. Please do not include personal data of other identifiable individuals or confidential information in your submissions unless you have the necessary rights and permissions to do so.

2.5 Use of Cookies and Similar Technologies

We use cookies and similar technologies on the Berlin auf die Eins website to recognise visitors' preferences and optimally tailor the Platform. This facilitates navigation and enhances user-friendliness. Cookies and other technologies also help us identify particularly popular areas of our online offering, keep you securely logged into your dashboard, and measure the performance of our content.

Cookies are small text files stored on your device. They enable us to store information over a certain period and recognise your device. For improved user guidance and individualised performance, we use persistent cookies. We also use so-called session cookies, which are deleted automatically when you close your browser. You can set your browser to inform you when cookies are set. Important: If you completely block cookies, some Platform functions — including logging in to your dashboard — may not be available.

Depending on their purpose, we distinguish between essential, functional, statistical, and marketing cookies.

Your selection is stored in a "CookieConsent" cookie so that your settings are respected on subsequent visits. You can change or withdraw your consent at any time via the "Cookie settings" link in the footer.

The following data are processed in this context:

  • Date and time of consent
  • The version of the consent record
  • The user's consent status per category (as proof of consent)

The "CookieConsent" cookie is stored for 12 months. You will then be asked for your consent again. The consent record is stored locally in your browser and is not transmitted to a third-party consent service.

2.5.1 Strictly Necessary Cookies

Necessary cookies are required for the basic functionality of the Berlin auf die Eins website and for operating the dashboard (e.g. session/authentication cookies that keep you logged in). They include only technically necessary services. These services cannot be objected to. They are used on the legal basis of Sec. 25(2) No. 2 TDDDG in conjunction with Art. 6(1)(b) (contract initiation or performance) and (f) GDPR (overriding legitimate interests). Our legitimate interests particularly include monitoring the technical performance of the Platform and keeping user accounts secure. Therefore, you as a Platform user cannot deactivate them via our cookie settings.

2.5.2 Analytics Cookies

These cookies help us collect visitor numbers and sources in order to measure and improve the Berlin auf die Eins Platform's performance. They show us which pages are popular, which are less used, and how visitors move around the site. All information collected by these cookies is aggregated and therefore anonymous.

Legal basis: Processing of data in connection with statistical cookies is based on your consent pursuant to Art. 6(1)(a) GDPR. In addition to Google Analytics, we may use other third-party services on the Berlin auf die Eins website to help us analyse the use of our offerings and optimise our marketing measures.

2.5.3 Targeting and Performance Cookies

Targeting and Performance cookies are used by us and third parties to record individual user behaviour, analyse the collected data, and, for example, display personalised advertising. These services enable us to track users across multiple websites.

Among other things, we use tracking technologies from Meta Platforms Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland, to evaluate and target our advertising on Facebook and Instagram. Personalised ads may be displayed based on users' location data and interests. The data collected helps us measure and optimise the effectiveness of our campaigns.

We also use targeting cookies via Google Ads, a service provided for persons from Europe, the Middle East, and Africa (EMEA) by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, and for all other persons by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (together "Google"). Analytics, Targeting, and Performance services are used based on Sec. 25(1) TDDDG (consent for setting or reading cookies) in conjunction with Art. 6(1)(a) GDPR (consent for the resulting data processing). Data processing begins only after you have given your explicit consent (opt-in). You can withdraw your consent at any time with effect for the future by clicking on "Cookie Preferences" in the footer of the Berlin auf die Eins website. The withdrawal does not affect the lawfulness of processing based on consent before its withdrawal.

3. Social Media

We operate dedicated Berlin auf die Eins social media pages, in particular on Facebook and Instagram, operated by Meta Platforms Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland, as well as a Berlin auf die Eins LinkedIn page (LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland) and a Berlin auf die Eins Luma page (Luma Labs Inc., 2261 Market Street #4438, San Francisco, CA 94114, USA). We have no influence over this data processing; the privacy notices of the respective providers apply.

We receive "Page Insights" (or comparable analytics) from these platforms — statistical, anonymised evaluations of user behaviour (e.g. demographic data, interests, interactions). These help us optimise our content and offerings. For this processing, we and the respective platform provider are joint controllers pursuant to Art. 26 GDPR. If you contact us directly on one of the Berlin auf die Eins pages or share content with us, we process your data as an independent controller to handle your inquiry (Art. 6(1)(b), (f) GDPR).

4. YouTube Videos with Enhanced Privacy Mode

We may integrate videos from YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA, that are not stored on our own servers. When you visit Berlin auf die Eins pages containing embedded videos, the website loads content from the third-party provider YouTube, which provides the videos. This gives YouTube the technically necessary usage data. We use YouTube in enhanced privacy mode. According to YouTube, this mode means YouTube does not store information about visitors on this website before they watch the video. However, enhanced privacy mode does not necessarily exclude data sharing with YouTube partners. For example, a connection to the Google DoubleClick network is established regardless of whether a video is viewed.

The embedding of YouTube videos is based on our legitimate interest in an appealing website design, public relations, and communication pursuant to Art. 6(1)(f) GDPR in conjunction with § 25(2)(2) TDDDG.

5. Newsletter

You can subscribe to the Berlin auf die Eins newsletter, which we use to inform you regularly about the initiative, new ideas submitted on the Platform, events and news. We use a double opt-in process: only after you confirm your subscription by clicking the link in a confirmation email will the newsletter be activated. We store your email address as well as the time and IP address used for the subscription to document the signup. The legal basis is your consent under Art. 6(1)(a) GDPR. You can unsubscribe at any time via the link included in every email or by contacting us.

6. Data Processing in Connection with Events

6.1 Register for Berlin auf die Eins Events

When you register for a Berlin auf die Eins event, we process the following categories of personal data: name, email address (private or business), company, position, and business address. We use this data in particular for the following purposes: sending confirmation of your registration, creating name badges at in-person events, supporting you before, during, and after the event, preparing participant lists, and sharing participant lists with speakers for better event preparation.

We use the event management platform Luma, operated by Luma Labs Inc., 2261 Market Street #4438, San Francisco, CA 94114, USA, to organise and manage our online and in-person events (e.g. registrations, invitations, RSVPs, and communication with participants).

When you register for an event via Luma, the personal data you provide (such as name, email address, company, position, and any other information you choose to share) is processed by Luma for the purpose of managing your registration and participation.

Data may be transferred to the United States. To ensure an adequate level of data protection, Luma relies on the Standard Contractual Clauses (SCCs) approved by the European Commission.

The use of Luma is based on Art. 6(1)(f) GDPR, as we have a legitimate interest in the efficient organisation of our events, and, where you provide consent to receive communications about future events, on Art. 6(1)(a) GDPR.

6.2 Event Attendees

In the case that you attend an event through Berlin auf die Eins, The Delta's standard event privacy policy applies in addition to this Berlin auf die Eins Privacy Policy. It is available at: https://thedelta.io/privacy.

7. Disclosure to Third Parties and Processors

Your personal data will only be disclosed to third parties if this is necessary to fulfil our contractual or legal obligations, a legal permission exists, or you have given consent. We conclude processing agreements under Art. 28 GDPR with all service providers we use.

Recipients of personal data:

Within the company: Access is granted only to those persons who need it to perform their tasks.

Within the Delta Group: In certain cases, we also transfer personal data to affiliated companies within The Delta Group, where this is necessary for internal administrative purposes, data analysis, financial management, or the execution of joint projects and marketing activities. These entities include in particular:

  • The Delta Campus GmbH, Donaustr. 44, 12043 Berlin, Germany (e.g. for administrative and operational support within Germany)
  • The Delta DE GmbH, Donaustr. 44, 12043 Berlin, Germany (e.g. for finance and internal reporting purposes)
  • The Delta Europe GmbH, Switzerland (e.g. for data analysis and business development)
  • The Delta Group AG, Liechtenstein (holding company, for corporate management and compliance oversight)
  • The Delta Studio (Pty) Ltd, South Africa (e.g. for support in software development, recruitment, and marketing initiatives)

We have concluded an Intercompany Data Processing and Transfer Agreement within The Delta Group, which governs any intra-group data transfers and ensures that such transfers take place in accordance with applicable data protection laws.

Other recipients in the public sphere: Because Berlin auf die Eins is a public-facing idea platform, the content you choose to make public (your name, public profile information, and submitted ideas) is visible to all visitors of the Berlin auf die Eins website and may be accessed, indexed or archived by third parties including search engines. See Section 2.4 for details.

Processors: Certain processing may be carried out by our service providers. In addition to the providers mentioned in this Privacy Policy (in particular Vercel, Supabase, HubSpot, Google, Meta, LinkedIn, Luma, Pxier and Cookieskript), this may include, in particular, data centres that host our website and databases, software providers, IT service providers who maintain our systems, agencies, market research companies, group companies, and consulting firms. Where we transfer data to our service providers, they may use the data solely to fulfil their tasks. The service providers are carefully selected and commissioned, contractually bound to our instructions, have appropriate technical and organisational measures to protect data subjects' rights, and are regularly monitored by us.

Public authorities: Authorities and courts where we are legally obliged or to protect legitimate interests.

Private entities: Business partners, cooperation partners, or non-instructed service providers where necessary for contract performance.

8. Is Data Processed Outside the European Union?

For certain processing operations, we use service providers located in so-called third countries outside the European Union (EU) and the European Economic Area (EEA). In such cases, we ensure that an adequate level of data protection is maintained in accordance with Articles 44–49 GDPR.

Where service providers are based in the United States and are certified under the EU–U.S. Data Privacy Framework (DPF), the adequacy decision of the European Commission dated 10 July 2023 applies, ensuring an appropriate level of protection for personal data.

If no certification under the DPF exists, we implement suitable safeguards to protect your data, in particular by concluding the Standard Contractual Clauses (SCCs) approved by the European Commission (Decision 2021/914/EU) with the respective service providers, and by conducting corresponding transfer impact assessments (TIAs) where necessary.

9. How Long Is Data Stored?

We store personal data only for as long as necessary for the respective processing purposes. Specifically:

  • Account and profile data: stored for as long as your Berlin auf die Eins account is active. After account deletion, we delete or irreversibly anonymise the data unless longer retention is required by law or to establish, exercise or defend legal claims.
  • Submitted ideas (public content): remain visible on the Berlin auf die Eins website until you remove them, withdraw your consent, or delete your account. After withdrawal, we take the content offline promptly; archived or aggregated non-identifying versions may be retained for statistical purposes.
  • Log files: see Section 2.1 (up to 14 days).

  • Contact enquiries: for the duration of active communication and applicable legal retention periods.

If you have consented to the use of statistical cookies, these remain stored until you withdraw your consent.

10. Your Rights

  • Right of access: You have the right to obtain information about the personal data we store about you.
  • Right to rectification and erasure: You can request the correction of inaccurate data and, where the legal requirements are met, the deletion of your data. Many of these changes can be made directly from your Berlin auf die Eins dashboard.
  • Restriction of processing: You can request that we restrict the processing of your data where the legal requirements are met.
  • Data portability: If we process your data based on a contract or consent, you may, where the legal requirements are met, request to receive the data you have provided in a structured, commonly used, and machine-readable format, or that we transmit it to another controller.
  • Objection: You have the right to object at any time, on grounds relating to your particular situation, to processing of your data based on our legitimate interests. If you exercise your right to object, we will stop processing unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms.
  • Objection to direct marketing: Where we process your personal data for direct marketing purposes, you have the right to object at any time to such processing. If you exercise this right, we will stop processing your data for this purpose.
  • Withdrawal of consent: If you have given us consent to process your personal data — for example, for the public display of your name and ideas on Berlin auf die Eins, for the newsletter, or for statistical and marketing cookies — you may withdraw it at any time with effect for the future. The lawfulness of processing based on consent before its withdrawal remains unaffected.
